INTERPRETATION
In these Terms and Conditions ( Terms ), the following words and phrases shall have the following meanings:
“the Buyer” means the person, firm or company who purchases the Goods from the Company:
“the Company” means Owaboo Limited;
“Contract” means the contract between the Company and the Buyer which shall be deemed to incorporate these Terms;
“Goods” means any goods agreed in the Contract to be supplied by the Company to the Buyer;
“Place of Delivery” means the place to which the Goods are to be delivered.

DELIVERY
Deliveries will normally be made within 10 days from receipt of order unless otherwise agreed. The Buyer will be advised of any delay, or if the item is not available.
Unless otherwise agreed in writing, the Place of Delivery shall be the Buyer’s principal premises provided at the time of ordering and the Buyer shall take delivery within 7 days of the Company notifying the Buyer that the Goods are ready for delivery.
Any dates specified by the Company for delivery of the Goods are intended to be an estimate only. If no date is specified for delivery of the Goods, delivery shall be within a reasonable time.
Subject to the other provisions of these Terms, the Company shall not be liable for any loss, whether direct or consequential, economic or loss of profits or otherwise, arising directly or indirectly out of any delay in the delivery of the Goods nor will any delay entitle the Buyer to terminate or rescind the Contract unless the delay exceeds 60 days.
Delivery is charged at a fixed rate of £6.50 (free over 150 cards) for the UK mainland and will arrive via Royal Mail. Costs for delivery to other areas including overseas will based upon the weight and size and will be added to the order.
In the unlikely event that Goods are lost or damaged in transit please contact the Company via email. In the case of non-delivery please wait 21 days from the date of order in case it has been delayed. In the case of damaged Goods please retain the product and contact the Company within 48 hours of receipt.

AVAILABILITY
All products and services are subject to availability and may be withdrawn at any time. The Company will endeavour to keep the site fully updated with new products and removing old ones. If an order cannot be fulfilled the Company will notify the Buyer with an option of waiting for the product to become available or be given a full refund for the product which is unavailable.

RISK IN THE OWNERSHIP OF GOODS
Risk in the Goods shall pass to the Buyer on delivery. Ownership in the Goods shall not pass to the Buyer until the Company has received in full in cleared funds all sums due to the Company in respect of the Goods and all other sums which are or may become due to the Company from the Buyer on any account.
Until ownership of the Goods has passed to the Buyer, the Buyer shall:
- hold the Goods on a fiduciary basis as the Company’s bailee;
- store the Goods separately from all other goods of the Buyer or any third party in such a way that they remain identifiable as the Company’s property;
- not destroy or deface any identifying mark on the Goods or their packaging; and
- maintain the Goods in satisfactory condition

PRICE AND MINIMUM ORDERS
The price for the Goods shall, unless otherwise agreed, be the price set out on the date of delivery in the Company’s price list. All prices set out are in pounds sterling. The costs of carriage (set out in ‘Delivery’ above) and applicable VAT shall be paid by the Buyer in addition. The Company does not arrange insurance for the Buyer. A minimum order of £50.00 excluding VAT and delivery applies to all orders.

PAYMENT
The Company shall not be bound to deliver the Goods until the Buyer has paid for them.
Payment shall not be deemed to have taken place until the receipt by the Company of cleared funds.

CANCELLATION & RETURNS
Goods may be returned within 14 working days from receipt. Delivery charge and returned postage will only be refunded if the Goods are faulty. If Goods are received in a damaged condition please inform the Company within 48 hrs of delivery by email (sales@owaboo.co.uk) to arrange for replacement Goods to be sent. The Company will require a reasonable opportunity to inspect the Goods in question
Please ensure that Goods are returned unused and in a resaleable condition (including the packaging).

It is advisable to obtain a proof of posting when returning items, as Goods remain the responsibility of the Buyer until received by the Company.
In the event that the Goods are not in resaleable condition, the Company reserves the right not to provide a refund and the Buyer will be responsible for the cost of such Goods being returned to you, within 28 days of our notification.

Owaboo and owaboo.co.uk are either trademarks or registered trademarks of Owaboo Limited. Other product and company names mentioned on this website may be the trademarks or registered trademarks of their respective owners.

DATA PROTECTION & PRIVACY POLICY
The Company is committed to protecting the Buyer’s privacy and will only use information collected about the Buyer lawfully in accordance with the Data Protection Act 1998. The Company requests the Buyer’s name and address to enable the Company to provide an efficient after-sales service but WILL NOT pass names and addresses to ANY third parties. If a Buyer makes a purchase they will be added to a customer database for the future receipt of the Company’s news and updates unless the Buyer specifies otherwise.

REFUSAL OF TRANSACTION
The Company reserves the right to withdraw any products from this website at anytime and/or remove or edit any materials or content on this website. The Company may refuse to process a transaction for any reason or refuse service to anyone at any time at its sole discretion. The Company will not be liable to the Buyer or any third party by reason of its withdrawing any product from this website whether or not that product has been sold; removing or editing any materials or content on the website; refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

To the fullest extent permitted at law, Owaboo Limited is providing this web site and its contents on an "as is" basis and makes no (and expressly disclaims all) representations or warranties of any kind, express or implied, with respect to this web site or the information, content, materials or products included in this site including, without limitation, warranties of merchantability and fitness for a particular purpose. In addition, Owaboo Limited does not represent or warrant that the information accessible via this web site is accurate, complete or current.
Price and availability information is subject to change without notice.
